Scott provides a crucial framework for understanding this struggle in his works “Seeing Like a State” and “The Art of Not Being Governed.” Scott argues that modern states have an insatiable appetite for what he calls “legibility”—the ability to read, categorize, map, and ultimately control their subjects. Throughout history, governments have invested enormous resources in making populations legible through censuses, standardized measurements, administrative categories, identity documents, and bureaucratic systems.
The drive for legibility isn’t inherently malicious—it enables states to provide services, collect taxes, maintain order, and coordinate large-scale activities. But Scott demonstrates how this same impulse becomes oppressive when it overrides local knowledge, individual autonomy, and organic social arrangements. The state’s need to “see” its population clearly often conflicts with individuals’ desire to remain autonomous and free from excessive oversight.
What makes our current moment historically unique is that digital technology has made human behavior more legible than any government in history could have imagined. Every click, purchase, location, relationship, and communication can now be tracked, stored, analyzed, and weaponized. The constitutional framers who crafted privacy protections couldn’t have anticipated that correspondence could be automatically scanned for keywords, movements tracked via pocket devices, or associations mapped through social networks.

Early Computing & Constitutional Foundations (Pre-1930s)

Turing’s work demonstrated both the power of computational cryptography and its dual nature: the same mathematical principles that could protect Allied communications could also be used to break enemy codes.
This duality would define the entire crypto landscape. Cryptography—the art of secret writing—relies on mathematical problems that are easy to compute in one direction but computationally infeasible to reverse. Think of it like mixing paint: easy to blend blue and yellow into green, but nearly impossible to separate that green back into its original colors.
By the 1970s, public key cryptography emerged as a revolutionary concept. Instead of sharing secret keys (like having identical house keys), you could have a public key (like a mailing address anyone can use to send you encrypted messages) and a private key (like the only key that can open your mailbox). This breakthrough, developed by Whitfield Diffie and Martin Hellman, made secure communication between strangers possible for the first time in human history.
But governments weren’t thrilled about citizens having access to military-grade encryption. The U.S. classified cryptographic algorithms as munitions, literally treating mathematics as weapons. Pizzagate emerged as a perfect case study of how digital infrastructure could be hijacked for political destabilization. The tools that were supposed to liberate information were instead concentrating power and fragmenting shared reality.

Tor enabled anonymous web browsing. Blockchain technologies offered decentralized alternatives to traditional financial and information systems. These technical solutions emerged alongside a growing cultural awareness that the problem extended beyond surveillance to encompass the entire attention economy model.
The most important transformation was philosophical. Digital rights advocates began framing privacy not as something to hide but as a prerequisite for human dignity and democratic discourse. They argued that mass surveillance—whether governmental or corporate—fundamentally altered human behavior in ways that undermined both individual autonomy and collective decision-making.

A Vision for the New Internet
This historical trajectory brings us to the present moment. The original internet’s decentralized architecture is being slowly rebuilt by a new generation of cypherpunks who understand that technical solutions alone aren’t sufficient—we need new economic models, governance structures, and social contracts.
The vision emerging from this digital awakening isn’t just about privacy tools—it’s about fundamentally restructuring the relationship between individuals and institutions in the digital age. Instead of data being extracted and monetized without consent, individuals could retain ownership of their digital footprint while still benefiting from network effects and collective intelligence.

Fully homomorphic encryption allows computation on encrypted data without decryption—meaning you can get insights from data without revealing the underlying information. Zero-knowledge proofs let you prove you know something without revealing what you know. Decentralized autonomous organizations (DAOs) enable governance without centralized control.
What’s missing isn’t technology—it’s adoption. The network effects that made surveillance capitalism dominant could theoretically make surveillance resistance dominant, but only if enough people choose privacy-preserving alternatives over convenient surveillance tools.
This is where the historical pattern becomes clear. The same dynamics that drove previous resistance movements—the tension between institutional control and individual autonomy—are playing out again in the digital realm. The question isn’t whether surveillance capitalism can be challenged, but whether enough people will choose alternatives that prioritize human agency over institutional convenience.
That’s the promise of the emerging digital resistance: not to retreat from connectivity but to rebuild it on foundations that prioritize human agency over institutional control. The privacy revolution isn’t just about protecting data—it’s about protecting democracy itself.
